🚨 IMPORTANT UPDATE FOR REAL ESTATE PROFESSIONALS & INVESTORS 🚨

On March 19, 2026, a federal court in Texas struck down (vacated) FinCEN’s Residential Real Estate Anti-Money Laundering (AML) Rule.

👉 The court found that FinCEN overstepped its authority under federal law (Bank Secrecy Act) and violated proper rulemaking procedures.

📢 What This Means RIGHT NOW:

✅ You are NOT currently required to file real estate reports with FinCEN
✅ You are NOT liable for failing to report while the ruling is in effect

FinCEN has officially stated this in their alert.

⚠️ BUT — Stay Alert

This is not necessarily final.

👉 If FinCEN appeals, the rule could come back into effect temporarily

👉 A court could issue a stay, meaning compliance requirements could return quickly

🏡 Quick Recap of the Rule (Now Paused):

• Took effect: December 1, 2025
• Reporting began: March 1, 2026
• Applied to:
➤ Non-financed residential real estate transfers
➤ Involving LLCs, corporations, trusts, and other entities
• Goal: Combat money laundering in real estate transactions

Financial elder abuse is more common than people think — and it’s not always obvious 🚨

It can look like:
• Pressuring an elderly person to give money or access to their accounts
• Using guilt, fear, or urgency to manipulate them financially
• Taking control of their finances or limiting their access to their own money
• Using their cards, withdrawing money, or transferring assets without permission
• Pressuring them to change wills, property, or legal documents
• Isolating them from family so no one notices what’s happening
• “Borrowing” money with no intention of paying it back

This isn’t help — it’s exploitation.
