Poland-Belarus
Western officials are accusing Belarus of intentionally trying to create a new migrant crisis in Europe. Poland has now amassed thousands of troops on its border with Belarus to keep out migrants who recently tried to push across the border, repeatedly attempting to tear down the razor-wire fence erected on Poland's eastern border. At least 2,000 people are now camped out there in freezing temperatures, caught in the middle of an international row. EU officials say Belarusian President Alexander Lukashenko is letting asylum-seekers from the Middle East into his country, and then funneling them into the EU.

Effective August 11, 2020, no person, including Judges, Employees, Attorneys, Vendors, Police custody persons, inmates, or anyone in the public will be allowed entry into our courthouses in the Third Circuit who:

Traveled outside of Hawai‘i in the past 14 days, or have traveled inter-island to the Second, Third, or Fifth Circuit on or after August 11, 2020 and 14 days has not passed since such travel.

This exclusion shall remain in effect until September 1, 2020, or further order of the Court. In consultation with the other Chief Judges, we are imposing this bright line exclusion. Please notify your membership. Thank you.

Trust that no one on DCCA is in immediate danger of deportation. As heartbreaking this status currently seems to be we must look to Congress to pass comprehensive reform. EB-5 Visa Program envisioned lawful permanent resident status for immigrant investors who invest in and engage in the management of job-creating commercial enterprises within the US. In 2012 Congress reaffirmed its commitment to the regional center model of investment and job creation by removing the word “Pilot” from the now twenty-year old program, and by providing a three-year reauthorization of the regional center model through September 2015.

New Report Shows Current U.S. Immigration Policy Hurts Our Economy
Today the Immigration Policy Center, a Washington D.C.-based think tank published a eye-opening report on how our failed immigration policy is adversely impacting our economy and global competitiveness. I have been writing in previous blogs about my observations and personal experience on this topic, but here is some real empirical and unbiased data on how critical the situation is. The full report is available here.

Among the key findings are that while the world has changed, our approach to immigration has not. For example, changing demographics in the U.S. has created a demand in lesser skilled jobs in the construction hospitality industry but current quotas allow for only 5,000 visas annually for these workers. The report concludes, "The inflexible and insufficient number of green cards available for these types of jobs is at the heart of the unauthorized immigration problem." Similarly, for skilled workers, including advanced degree graduates of our institutions of higher learning and research, the confusing and conflicting maze of laws and regulations have meant that less than 10% of foreign students from India and China (ie our competition) are planning to stay in the U.S. and look for work after graduation. More sobering than that is the idea that many of our chief global economic competitors are offering enticements to immigrate rather than creating barriers.

In 2009, President Obama vowed to overhaul the nation's immigration detention system. Since then, his administration has taken some steps to deliver on that promise, such as providing detainees improved access to medical care and closing troubled facilities. But it has yet to provide the most meaningful fix: ensuring that indigent immigrants in detention have access to legal counsel.

Until now, federal courts have held that only criminal defendants are entitled to court-appointed counsel. An immigration case, even if it involves detention, is a civil matter. As a result, the vast majority of detainees, including children and the mentally ill, are forced to represent themselves in immigration court.

Aliens who are inadm issible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to
6 the United States:
7 (1) Health-related grounds
8 (A) In general.
9 Any alien-

(i) who is determined (in accordance with regulations
11 prescribed by the Secretary of Health and Human Services) to have
12 a communicable disease of public health significance, which shall
13 include infection with the etiologic agent for acquired immune
14 deficiency syndrome,
(ii) except as provided in subparagraph (C), who seeks

17 the status of an alien lawfully admitted for permanent residence,
18 and who has failed to present documentation of having received

22 and hepatitis B, and any other vaccinations against vaccine23
preventable diseases recommended by the Advisory Committee for
24 Immunization Practices,

The federal government may seek to deport someone for any number of reasons, including:

Misrepresentation on a visa or naturalization applications and other documents
Overstaying a visa and unlawful presence (ULP)
Employment against immmigration law or terms of the visa
Violations of foreign residency requirements
Crimes involving moral turpitude (CIMT)
Aggravated felonies
