After hearing Sheriff Mooney's comments, the first question in my mind is how two probable cause affidavits were signed before a notary with the specific language in the template that is described as prank language? The language is obviously language that should not be in any form or template of a probable cause affidavit, regardless of where is appears in the affidavit (i.e., notary block section, form language outside of the substantive facts of the affidavit as well as the substantive facts section itself), and anybody who reads an affidavit carefully before signing it before a notary should see that this "prank language" should not be in the affidavit. The language NEVER should have been there in the first place, and as an attorney I recognize how such language being in a signed/notarized probable cause affidavit might indeed support the affidavit being thrown out in a criminal case and cause significant problems with the efforts of a District Attorney's office to successfully prosecute a defendant for an alleged crime, but the affiant in a probable cause affidavit should know that he/she has to read the affidavit carefully to ensure its truth and accuracy before signing it before a notary public because that probable cause affidavit is the "lifeline" to the arrest of the defendant and any eventual successful prosecution. As part of his investigation of the matter, I sure hope that Sheriff Mooney is looking carefully into how in the world TWO probable cause affidavits signed before a notary public with this prank language contained within outside of why/how the language made its way into the probable cause affidavit in the first place.
