If Congress doesn't step in, by January 1, 2026, the amounts you can exempt from estate, gift, and generation-skipping transfer (GST) taxes will be cut in half. This could mean families with taxable estates under federal law might face much higher transfer taxes. But don't worry! There are still plenty of ways for families with significant assets to plan and use the current exemption levels.

Back in 2017, the Tax Cuts and Jobs Act (TCJA) doubled the estate and gift tax exemptions from $5.6 million per person (or $11.18 million per married couple) to $11.18 million per person (or $22.36 million per married couple), adjusting for inflation each year. Fast forward to 2023, and the estate and gift tax exemption is now at $12.92 million per person (or $25.84 million per married couple).

But here's the catch: the TCJA is set to expire at the end of 2025. Assuming the estate and gift tax exemption has risen to $14 million by then (thanks to inflation adjustments), without Congress stepping in, the exemption could drop to about $7 million per person or $14 million per married couple. This could lead to much higher transfer taxes for some families, possibly costing millions of dollars.
