In a residential custody arrangement, the Parent of Primary Residence (PPR) is generally the parent with whom the child lives for more than 50% of the time. If a 50/50 parenting time agreement exists, a parent may be designated the Parent of Primary Residence for educational purposes only, which permits the designated parent to enroll the child in their respective sending district.

However, the designation involves more than where the child sleeps. The PPR may also handle many day-to-day responsibilities, including:

- School routines and transportation
- Medical and other appointments
- Everyday decisions affecting the child
- Keeping the other parent informed about the child’s well-being

Major decisions involving education, healthcare, and other important matters may still need to be made jointly when parents share legal custody.

When parents disagree about residential custody, New Jersey courts focus on which arrangement best serves the child's best interests.

Can Text Messages Be Used in Court?

The short answer is yes, but not every text message will automatically be accepted as evidence.

In New Jersey, text messages may be used in legal proceedings when they are relevant to the issues in the case and can be properly authenticated.

The admission of text messages must also comply with the Rules of Evidence, a complicated set of rules that even trip up experienced attorneys.

One of the first questions people ask when considering divorce is, "How much is this going to cost?" The truth is, there isn't a one-size-fits-all answer. The cost of a divorce depends on factors such as:

- Whether the divorce is contested or uncontested
- Child custody or parenting disputes
- Property and asset division
- Alimony or support issues
- Whether mediation or court is required

Many other complicating factors determine the cost of a divorce. For example, if there is a corresponding restraining order that must be handled, that will mean additional costs are incurred. If there is significant motion practice, including an initial motion for pendente lite relief, that will incur additional legal costs. There may also be costs such as subpoenas, depositions, and experts that can add thousands in additional costs.

Understanding what drives the cost of a divorce can help you make informed decisions and potentially avoid unnecessary expenses.

Do you know how a restraining order works in New Jersey?

If you're facing a domestic violence situation—whether you're seeking protection or responding to a restraining order—understanding the legal process is essential.

From obtaining a Temporary Restraining Order (TRO) to the hearing for a Final Restraining Order (FRO), each step can have significant legal consequences. In New Jersey, a Final Restraining Order can remain in effect indefinitely unless the court orders otherwise.

Before taking action, make sure you understand your rights and what to expect.
