If an engagement is called off, what happens to the ring?

Michigan follows the common law rule that an engagement ring is a gift in contemplation of marriage. The affirming case under Michigan law is Meyer v Mitnick, 244 Mich App 697 (2001).

This means that if an engagement is called off the ring must be returned to the purchaser.

What is the statute of limitations?

The statute of limitations is a defense that an accused person can assert when the prosecutor waits too long to file charges in criminal court.

The purpose of this rule is to make sure that charges are filed within a reasonable amount of time, evidence and memories are fresh and reliable.

Most offenses, felonies and misdemeanors, have a statute of limitations of six years. This means that if six years should pass from the time the offense is committed and a person is then charged with the crime they can assert the defense in court to have the case dismissed.

What do I need to do if you have a warrant?

An arrest warrant is issued after a prosecutor reviews a police officer’s report and makes the decision to charge the person under criminal investigation with a crime. The warrant request is entered into the court by the police officer under oath, and the judge or magistrate issues the warrant.

The purpose of the warrant is to get the accused person to court to answer to and defend that charges against them.

It is possible that police will then go to a person’s residence to arrest them. More common is a bench warrant, which means no one is actively coming to arrest the person accused of a crime but if police have contact with the person and learn of the outstanding warrant an arrest will be made. This can be extremely inconvenient if the accused person has police contact late on Friday or over the weekend. In that situation, police will arrest them and hold them at the police station until a judge or magistrate can see them. This means that the person could be waiting hours or even days in a small jail cell.

Once a person is arrested, they are taken to the courthouse to be arraigned by the judge. The arraignment will remove the outstanding warrant, and it will also start the proceedings of the criminal case.

Generally, a bond will be issued at arraignment, which is a promise to return to court secured by money. Depending on the type of charge, the case will be set for a pretrial or a probable cause conference.

If you are aware of a warrant out for your arrest, the best thing to do is to hire a lawyer and go to the court to have the warrant removed. By going to the courthouse on your accord, without the police having to take you there in handcuffs, you will likely get a more favorable bond. Showing up to court with a lawyer shows the court that you are more likely to continue to come to court to defend the charges against you, and that you are less likely to be a flight risk.

How does evidence suppression work?

In a criminal case you hear about evidence being thrown out or suppressed. This most commonly happens due to a person’s Fourth Amendment right against illegal search and seizure being
violated.

When police illegally obtain evidence the remedy for the accused is that the evidence is tossed out of court -suppressed.

When police conduct an illegal search that leads to evidence being found that evidence is referred to as fruit of the poisonous tree. Anything obtained after the illegal search cannot be used in court against the accused.
