WORKERS MUST BE PAID FOR CALL-IN SHIFTS

Employees had "Call-In" shifts requiring the employee to spend 5 to 15 minutes calling the manager to find out if he or she should show up. The call had to be made within a set period of time before the Show-Up shift.

Employees were oftentimes scheduled for 3 or 4 Call-In shifts three to four times per week and they only worked approximately 1 or 2 these shifts.

The 9th Circuit followed Ward v. Tilly and concluded the Call-In shifts should have been paid.

California Employees Must Be Paid for All "Hours Worked" California protects workers' rights to compensation. It has a very broad definition of "hours worked." It includes any time an employee is suffered or permitted to work and any hours an employee is subject to the employer's control.
