When is the best time to estate plan?

What is the difference between a will and trust?

While there are many similarities between wills and trusts, there are also important differences between the two. At their core, both a will and a trust are a set of instructions for how your assets and belongings (your “estate”) should be distributed. The key difference between the two is that a will simply directs how your estate should be distributed, while a trust is a new entity that you have created, and that you control, which takes ownership of your estate then directs its distribution.

That key difference has many important effects on estate planning. Because a trust is a new entity that owns your estate for you, if you have a properly created trust, your estate will not need to go through the probate process. A trust also gives you more flexibility in estate planning than a will. If you use a trust for estate planning, you can allow your loved ones to receive their inheritance in installments, instead of a lump sum. You can also direct that the funds be used for specific purposes, ensuring that your legacy is used to benefit your loved ones. This flexibility can often be a benefit when people are concerned that a loved one might spend their inheritance unwisely.

What is Probate?

Probate is the name for the legal process of distributing the assets and belongings of someone after they have passed away. If the person that passed away had a will or had no estate plan in place a probate is usually required.

I like to divide probate cases into two steps. The first step is for the court to authorize someone to manage the estate. This person is called the Personal Representative. The second step is for all of the persons assets and belongings to be gathered, categorized, and distributed.

Here in Utah, you can also have a more formal probate process. This generally happens when there is some disagreement about what should be done with the assets and belongings. In a formal probate process, the court oversees every action. This can cause the probate case to move very slowly and to cost substantially more. However, the probate can also be an informal process. An informal probate process usually occurs when everyone is in agreement about what should be done. In an informal probate, the court only oversees the first step of the probate process. An informal probate can usually move much more quickly than a formal probate case, and, for that reason, is much more economical.

After learning about the probate process many people are concerned about the effects that the stress and expense of probate could have on their loved ones. Luckily, there are estate planning strategies that, if done correctly, can ensure that your estate skips the probate process entirely, which can remove a great deal of stress from your loved ones.

How does estate planning help my loved ones?
