Hi, everyone -

On this new episode of the Standard of Review, I talk with Attorney Alex Bomstein of Clean Air Council about his win in Clean Air Council v. DEP. The case clarifies when plaintiffs challenging permits under Pennsylvania's Clean Streams Law can obtain attorney's fees from applicants, and is a win both for private enforcement of environmental rights and an excellent illustration of the principle that statutorily provided discretion imports statutory purpose.

I’m writing today to ask those of you in Pennsylvania to vote YES to retain Justices Christine Donohue, Kevin Dougherty, and David Wecht, and Judges Alice Beck Dubow and Michael Wojcik, in Tuesday’s election.

tl;dr: The short version of this message is that judges should be retained if they are faithfully attempting to interpret and apply the law, and all of these Justices and Judges pass that test easily.

In this episode of The Standard of Reivew, I spoke with Attorney Brandy Hoke of Jacobson, Julius, & Harshberger to discuss the Court's decision in Commonwealth v. Greer, which clarified when and how petitioners under the Post Conviction Relief Act can, and must, request new counsel and raise claims of ineffective assistance of prior PCRA counsel, on penalty of waiver. The case is required reading for anyone who practices in the criminal and postconviction spaces. Let's hope the episode is required listening, too.

In this episode, I got to sit down with Sue Frietsche of the Women’s Law Project, and discuss the Court’s recent decision overruling an earlier case permitting gender discrimination based on “physical differences.” The Court’s decision includes numerous holdings in areas from third party standing to constitutional interpretation to natural law, and is nothing short of a tour de force.
