I am very honored to have been able to both sponsor and participate in the 8th annual Officer Brian Shaw Memorial Scholarship Ride on Saturday, August 16th. Officer Shaw was a great, young officer with the New Kensington Police Department that was unnecessarily and brutally murdered on November 17, 2017 during a traffic stop. Don't wait to contact an attorney!

I have had several people reach out to me recently nearly two years from the date of their injuries seeking legal representation. This is a bad idea for several reasons.

First, depending on the type of case you have, evidence preservation is crucial. If you wait, it can be lost. Conditions of a premises change. Data stored within a vehicle can be lost. And, frankly, people don't save things. It is imperative to get a lawyer involved as soon as possible so that steps can be taken to preserve this evidence that could make or break your case.

Second, and more importantly, in Pennsylvania you, generally, have two (2) years from the date of your injury to either settle your claim or file a lawsuit. If you wait until the end of that two-year period, it makes it very difficult for the attorney to get a lawsuit filed, particularly if it is a medical malpractice case. You might have a really strong case but could have great difficulty finding an attorney to take your case if you wait.

Often times people think "I don't know if I want to pursue a case." That's okay. Just because you contact an attorney doesn't mean you have to pursue the case. You might not even have a case to pursue. But, waiting until the last minute is not the time to figure that out. Contact an attorney early to review all of your options. At least evidence can be preserved and an attorney can give you some advice as to whether there is a case to pursue.

At my firm, we offer a free consultation, we advance the costs to pursue the case, and you don't owe us anything unless and until we make a recovery on your behalf. So you won't be paying us just to talk to you about the case.

The first thing you need to do when you are hurt is to get medical treatment. But, as soon as you can after you have obtained emergent treatment, you should call us.

"I don't want to sue anyone."

This comes up often in injury claims. The thought of a lawsuit can be intimidating for some, so much so that it stops them from pursuing a claim. Also, people don't like to sue someone that they know, for example, if you are a passenger in a car and the driver is a friend or family member. Just because you pursue a claim does not mean you have to sue someone.

A lot of injury claims are resolved with the at-fault party's insurance company before a lawsuit is even filed. Generally, when you hire a lawyer, the lawyer reaches out to the insurance company, advises the insurance company of the representation, and then the lawyer deals with an insurance adjuster. Depending on the amount of insurance coverage available and the injuries/damages, if the claim can be resolved with the insurance company, then a settlement is reached and no one is ever sued.

To the extent a lawsuit does have to be filed for one reason or another, yes, a person or company has to be sued. But, his or her insurance company provides a defense attorney, pays for the costs of the attorney and the litigation, and, in most cases, the amount of any verdict or settlement.

Also, just because a lawsuit is filed, it does not mean that you are going to have to go to court and be in front of a jury. Often times lawsuits are filed just to keep the case moving along in case the insurance company is dragging its feet, or if a statute of limitations needs to be protected, but these are all specific decisions that have to be made on a case-by-case basis, and would be discussed with you before a lawsuit is filed.
