⚖️ DOAH Update: You're Still Stuck With It

A bill that would've at least given Citizens policyholders the choice of whether DOAH applies to their policy made it through committee and then died. It wasn't a perfect fix, but it was a start. Now even that's gone.

What that means: if you have a Citizens policy, you're still bound by whatever claim determination they make through the Department of Administrative Hearings, where Citizens wins the vast majority of cases (some sources cite 90-99% of the time).

Attorney Warren Duffy breaks down what this means for Florida homeowners right now - and why future changes likely won't apply retroactively to cases already in progress.

Is water collecting around your home's foundation? You might have a grading or drainage issue - and it's becoming more and more common in Florida as new communities are built in lower-lying areas.
Here's what to look for:

✅ Check your gutters and downspouts
✅ Look at the slope of your yard
✅ Watch for water pooling near your foundation

And if your home is less than 7 years old, you may have legal recourse against your builder or developer.

If you're in the middle of a disability claim - whether with Social Security or a long-term disability insurance company - here's something most people don't know: don't rely on your doctor's office to send your medical records.

Attorney Bill Demas has seen it happen more than once: a client watches their doctor fax the records, and the insurance company or Social Security still claims they never received them. Doctors are doing critical work, and paperwork isn't always the priority.

The fix is simple. Get your records yourself. Send them by trackable mail. Note the date, the doctor, and the page count. That's the only way to guarantee your records are in your file - and that you can prove it.

The insurance adjuster drove up, barely stepped out of the car, glanced at the front of the house - and left. Claim denied.

What they didn't do? Walk around back. Because if they had, they would have seen a massive hole in the roof.

This is why Jason Herman always tells clients: document your own damage, every inch of it, before anyone shows up. Don't assume the adjuster is there to help you. Their job is to protect the insurance company - not you.
