Herman & Wells

Herman & Wells More than settling. Florida law firm specializing in Personal Injury, Insurance Disputes, Construction Defects and Disability Disputes.

Jason Herman and Cliff Wells provide clients with legal advice about insurance, present claims to insurance companies to maximize client recoveries, and represent clients in lawsuits against insurance companies for personal injuries, property damage, and all types of insurance coverage. We know how to advocate to insurance carriers to get claims paid. We are also trial lawyers. If an insurance co

mpany won’t do what’s fair and right, we litigate cases, through trial and appeal if necessary. We also pursue insurers in bad faith lawsuits.

Mediation sounds formal but what actually happens when you get there?

In the latest Anatomy of a Case, Attorney Warren Duffy breaks down what mediation is, why it happens, and how it can help both sides work toward resolving a case without going to trial.

It’s an important step in many cases—and knowing what to expect can make the process a lot less mysterious.

Most people assume an injury case comes down to one simple question: who's at fault? But in Florida, it's rarely that black and white. Juries are tasked with dividing responsibility between everyone involved - including the injured person - and assigning a percentage to each side. That percentage isn't just symbolic. It's applied directly to the total damages awarded, which means it can significantly change what an injured person is able to recover.

We see this play out often in car accident cases, where one driver may have been slightly careless, but the other driver's negligence was far more significant. Understanding how comparative fault works can make a real difference in how you approach your case.

If you've been injured and aren't sure how fault might be divided in your situation, our team at Herman & Wells is here to help.

Big news coming soon! Founding partner Cliff Wells spent some time in the recording studio putting together our radio campaign with Kristi Knight of WDUV 105.5.

We can't wait for you to hear it - keep an ear out on the airwaves. In the meantime, here's a behind-the-scenes look at how it came together.

🤖 “Well, AI said…”

It’s the modern version of having a friend who used to practice law weigh in on your case.

Jason Herman explains what happens when a client brings information from AI into the conversation. Instead of dismissing it, we want to know where the information came from, check it ourselves, and explain where AI may be missing context -or where it might have a point.

Ask the questions. Bring us what you found. That conversation is part of the job.

Homeowners often trust that a warranty request will get their home issue fixed — but delays can drag on for months or even years. While you're waiting, Florida's statute of limitations doesn't stop the clock.

Construction Attorney Daniel Kennell breaks down the two key deadlines: 4 years for patent defects (issues visible when you move in) and up to 7 years under the statute of repose for latent defects like roof leaks - which gets cut short 4 years from when you knew or should've known about the problem.

Don't let a slow warranty repair cost you your legal rights. If you're seeing signs of an issue, talk to an engineer and an attorney before time runs out.

So much pain you can't get out of bed - but no pain medication in your medical records? That gap can hurt your disability claim.

Disability Attorney Bill Demas explains why it's not enough to just decline pain meds, you need to have an honest conversation with your doctor about why, whether it's addiction risk, family history, or fear of side effects. That reasoning needs to be documented, because judges look at your records, not just what you tell them at the hearing.
