Flight alone doesn't have to become a conviction.
Resisting without violence under §843.02 is a first‑degree misdemeanor in Florida, not a felony. That means prosecutors must prove four separate elements: a lawful duty, conduct that actually obstructed the officer, the person was an officer, and you knew they were an officer.
In many Tampa Bay cases the paperwork looks damning, but bodycam, dispatch logs, and the C.E.L. decision often give defense lawyers real openings. If you’re charged, say little, ask for an attorney, and insist your lawyer requests those records right away.
