We did it again 😎

Another successful habeas corpus petition that resulted in our client’s immediate release from detention. No bond hearing, no fees, no waiting.

A habeas corpus action is one of the most powerful legal tools available when someone’s liberty is at stake. It allows us to challenge unlawful detention in federal court and ask a judge to review whether the government has the legal authority to continue holding someone.

Not every immigration attorney handles federal litigation. Not every attorney is qualified to file habeas petitions. These cases require a deep understanding of both immigration law and federal court procedure, and they’re often pursued when every day of detention matters.

This year alone, we’ve filed more than 100 habeas petitions on behalf of our clients and their families.

When someone is being held unlawfully, we’re not interested in waiting around for the system to fix itself.

The honest answer right now is: it’s still too soon to fully know how broadly this policy memorandum will be interpreted and applied in real cases, which is exactly why individualized legal counsel is so important right now.

This memorandum does NOT mean green cards are no longer available, and it does NOT automatically mean every case will be denied or forced into consular processing abroad.

Every case is unique and depends on factors like lawful entry, immigration history, admissibility concerns, waivers, and the type of petition being filed.

One thing we really want immigrants and families to understand right now: do NOT allow fear tactics to pressure you into making rushed decisions about your case.

This administration has repeatedly used fear-based messaging surrounding immigration to push people toward certain actions, discourage people from pursuing benefits they may qualify for, or create uncertainty around existing immigration pathways.

We’ve seen it before with public charge fears, asylum-related messaging, “self-deportation” rhetoric, confusion surrounding work permits and DACA, and countless policy announcements that created panic long before courts, attorneys, and immigration agencies fully interpreted how those policies would actually be applied.

That’s exactly why understanding the difference between policy announcements, political messaging, and actual immigration law matters so much right now.

This memorandum does NOT mean green cards no longer exist, and it does NOT automatically eliminate pathways for everyone overnight. Immigration law is highly individualized, and every case depends on specific facts, immigration history, lawful entry, admissibility issues, and the type of petition involved.

Before making any major decisions about your case, make sure you’re getting information from trusted legal sources and experienced immigration attorneys who understand how these policies are actually being interpreted and applied.

My favorite animal is me when someone wrongfully detains a client 😉

“Habeas corpus” is a legal action used when someone is being unlawfully detained or held for an unreasonable amount of time. In immigration cases, it can be one of the tools attorneys use to challenge prolonged detention and ask a federal court to review what’s happening.

These cases are handled in federal court, and not every attorney is able to take them on. They require specific credentials, extensive legal research, strategy, and a deep understanding of both immigration and federal litigation.

Over the years, we’ve built a reputation for going to bat for our clients and holding agencies (and the people behind them) accountable when people are wrongfully detained.
