On 02/21/2023, the Biden administration released a new rule that will largely bar migrants who traveled through other countries on their way to the US-Mexico border from applying for asylum in the United States.

The rule was created to “encourage migrants to avail themselves of lawful, safe, and orderly pathways into the United States, or otherwise to seek asylum or other protection in countries through which they travel”

“Under the new rules, migrants who do not schedule an appointment at a U.S. border port of entry or use humanitarian programs available to certain nationalities would be ineligible for asylum except in certain cases.” Such as unaccompanied children.

This rule is expected to last two years.

GREAT NEWS!!! 📣📣

Yesterday, The Biden Administration announced that as of January 6, 2023, the Parole Process for Venezuelans will be expanded to Nicaraguans, Haitians, and Cubans. Up to 30,000 individuals per month from these four countries, who have an eligible sponsor and pass vetting and background checks, can come to the United States for a period of two years and receive work authorization. HOWEVER!!!Individuals who irregularly cross the Panama, Mexico, or U.S. border after the date of this announcement will be ineligible for the parole process and will be subject to expulsion!

Just hours before the policy was set to end, The Supreme Court ruled to extend the Title 42 policy. This means US border patrol can continue to expel migrants who have crossed the border seeking asylum. The Court will hear arguments in February 2023 and a final decision is due by June 2023.

On December 5, 2022, the Secretary of Homeland Security “announced the extension of Temporary Protected Status (TPS) for Haiti for an additional 18 months, from February 4, 2023, through August 3, 2024, due to extraordinary and temporary conditions in Haiti. He also redesignated Haiti for TPS, allowing Haitian nationals residing in the United States as of November 6, 2022, to apply for TPS through August 3, 2024, so long as they meet all eligibility requirements.
