6th Circuit: High-Earning Worker Misclassified as Salary-Exempt from Overtime

Lynwood Pickens sued Hamilton-Ryker IT Solutions, claiming he was misclassified as a salaried employee to avoid overtime pay under the Fair Labor Standards Act (FLSA). Despite being guaranteed $800 weekly, he was paid $100/hour for hours beyond 8 per week, regularly working over 50 hours. On April 1, 2025, the 6th Circuit Court of Appeals ruled that this arrangement did not meet the FLSA's "salary basis" test, as his pay was tied to hours worked, not a true weekly salary. The decision reverses the lower court's ruling and highlights the importance of proper employee classification. Appellate opinion available at https://tinyurl.com/2cpo4a6e
