Worker misclassification occurs when an employer treats someone as an independent contractor even though the person legally qualifies as an employee. Pennsylvania law states that a worker is considered an employee unless the employer can show that the worker qualifies as an independent contractor. Unfortunately, according to the Pennsylvania Department of Labor and Industry, approximately 259,000 employees are misclassified each year in Pennsylvania. This can cost workers important protections, including benefits, unemployment, as well as lost wages. If you believe you have been misclassified as an independent contractor, an experienced employment lawyer will protect your legal rights and recommend the most effective legal course of action. Employee vs. Independent Contractor: Why It Matters In Pennsylvania, the distinguishing difference between employees and independent contractors is important because it determines which workplace protections and benefits apply to you. “Classification” matters a great deal. For example, if you are an employee who has […]

Artificial Intelligence (AI) is being used during almost every stage of the hiring process, from identifying candidates and screening resumes to conducting and evaluating interviews. While these tools can help employers handle a large number of applicants, this technology can create concerns about discrimination. Unfortunately, the data used to build a system, how the algorithm evaluates an applicant, or the way an employer uses the results can put certain groups of applicants at a disadvantage. If an employer uses AI technology to make hiring decisions that are discriminatory, there are federal, state, and city laws in place that protect you against certain forms of employment discrimination. An experienced employment lawyer will thoroughly examine the details of your case, determine whether your rights have been violated, and recommend the best legal course of action. How Employers Use AI to Screen Applicants Employers may take advantage of AI at several points during the […]

Between hormonal fluctuations, fatigue, and morning sickness, and the significant changes the body undergoes, pregnancy can cause a range of physical and medical challenges that make it difficult to maintain the same level of productivity at work. Whether you need additional restroom breaks, a temporary change in responsibilities, or time away from work for medical appointments, these are all reasonable requests. Until recently, pregnant workers had to choose between a paycheck and the physical health of their pregnancy. Fortunately, with the Pregnancy Workers Fairness Act (PWFA), working parents have a powerful tool to protect their health and their livelihoods. If you are pregnant and your legal rights have been violated, it is highly recommended that you contact an experienced discrimination lawyer as soon as possible. What the PWFA Requires of Employers The PWFA is a federal law that took effect on June 27, 2023. Employers with 15 or more employees […]

Navigating workplace relationships can be complicated and confusing, particularly if you start to experience unprofessional behavior or feel uncomfortable. When the Medical Ma*****na Act (MMA) was passed in Pennsylvania in April of 2016, it gave hundreds of thousands of residents legal access to cannabis to help manage symptoms of qualifying medical conditions, including chronic pain, cancer, multiple sclerosis, and Post-Traumatic Stress Disorder (PTSD). It also prohibited employers from terminating employees who are certified to use medical ma*****na. However, while the law recognizes that patients who meet the requirements can legally use medical ma*****na, it does not give employees a free pass to use ma*****na any time they want, or to show up to work impaired. If you were fired for legal cannabis use, or you have questions about the MMA, it is highly recommended that you contact an experienced employment lawyer as soon as possible. What the PA Medical Ma*****na Act Protects The Pennsylvania MMA provides a number of protections for certified medical ma*****na patients, including the following: Certain […]

Key Takeaways: For employers and employees evaluating a 2026 non-compete agreement in Pennsylvania, enforceability depends on the agreement’s purpose, timing, scope, and industry. Pennsylvania courts scrutinize these restraints because they can limit a worker’s ability to earn a living, but properly tailored covenants may still be enforced. Are Non-Competes Enforceable in Pennsylvania? Yes, in some circumstances. Pennsylvania courts recognize non-competes connected to employment when the restriction is reasonably necessary to protect the employer and reasonably limited in time and geography. Legitimate interests can include trade secrets, confidential information, customer goodwill, and specialized training. What Makes a Restrictive Covenant Reasonable? An employer’s “restrictive covenant” in Pennsylvania should never be any broader than the interest it protects. Courts consider factors such as the restriction’s duration and geographic reach, the employee’s duties, access to confidential information, customer relationships, and whether the covenant protects a legitimate business interest rather than ordinary competition. Employers should […]
