Here is something the insurance company will not tell you: A lot of claims get denied for no real reason at all, even ones where the injury was witnessed from start to end.

Why would they do that? They deny the claim hoping you will do nothing about it. A lot of times, it works because so many injured workers get that denial and give up on it.

Do not be in that half. A denial is not the end of your case. A lot of the time, it is just the start of it.

A lot of people never call us because of one big thing: They have a pre-existing condition.

A pre-existing condition does not null your claim. Say you have arthritis in your knee, like most people do as they get older, and you're doing your job just fine without any treatment for it. You get hurt on the job and that old condition flares up to the point where you need surgery and can't work anymore. You might still have a case.

The injury does not have to start from scratch. If work made what you already had worse, you may still be owed benefits.

Can you be fired legally just because you got injured on the job and file a Worker’s Compensation claim?

The answer is absolutely not, but that doesn’t stop some employers from doing it anyway. Know that you are not doomed if this app happens and you have options.

Even the best case in the world can be lost.

You can walk into that hearing sure that you will win, and if the judge sees it differently, you walk out with little or nothing.

A settlement is money in your hands that no one can ever take back. Roll the dice at trial and lose, and there’s no going back for the resources you could have locked in. This is the risk of trial.

Your insurance adjuster is friendly. They call to check in and they seem like they’re on your side, so they are, right?

Most of the time, they are not. The adjuster works for the insurance company and gets paid by the insurance company. That’s who they answer to and it’s never going to be you.

A lot of injured workers convince themselves that if they just stay close to the adjuster, everything will work out. Some adjusters are reasonable. Most are not. Either way, you’re not required to talk to them and you should never mistake a nice phone voice for someone aiming to hurt your claim.

When you string together a bunch of “I don’t remember” answers in a deposition, it reads exactly like you’re hiding something, and Geoff will tell you that playing hide the ball hurts you just as much as exaggerating does.

Watch the video to see what to do instead.

You do not have to act polished to give a good deposition. You do not have to be smooth or a great talker or some Hollywood version of a witness.

All you need to do is tell the truth without the drama.

Geoff makes this point because a lot of injured workers walk in nervous and thinking they need to perform.

You do not.

If you get emotional talking about a serious injury and what it’s done to your family, that’s natural and it’s fine. What hurts you is exaggerating.

Go in crying over a hangnail and you’ve lost your credibility before you started.

What are some of the most common injuries we see in the workplace and why?

Forklift injuries, hands down. CEO Jason Krasno explains why we see this every week, and how to keep yourself safe if you work with/around forklifts.

Can you get fired for filing a Workers’ Compensation claim?

You can, and it happens all the time, but it is technically retaliation and illegal. That doesn’t stop it from happening though.

If this has happened to you, we highly recommend speaking to an attorney.
