Being paid a salary does not automatically mean you are exempt from overtime.

The U.S. Department of Labor recently secured $750,000 for restaurant employees who were misclassified and denied proper overtime pay. Under federal law, many employees must receive time-and-a-half when they work more than 40 hours in a week.

$1.73 MILLION in back wages. 1,666 workers. One payroll "shortcut."
A federal investigation found that a Tennessee contractor working at Ford's electric vehicle and battery campus allegedly left incentive bonuses out of its overtime calculations. Under the FLSA, nondiscretionary bonuses must be included in your regular rate of pay when calculating overtime. When they are not, every hour of overtime you work could be underpaid.
The result here? An average of more than $1,000 owed to each affected worker.

On June 25, 1938, one signature reshaped the American workplace.

Think your boss can hit you with a surprise pay cut?

A pay cut generally cannot be applied to hours you already worked. In many states, employers must give advance notice before lowering your rate going forward.
