On Monday, August 19, 2024 U.S. Citizenship and Immigration Services (USCIS) is opening applications for the expansion of Parole in Place (PIP) for spouses and stepchildren of U.S. citizens.

In order to qualify for PIP, an individual must:

🇺🇸 Be present in the United States without admission or parole;

🇺🇸 Have been continuously present in the United States for at least 10 years as of June 17, 2024;

🇺🇸 Have a legally valid marriage to a U.S. citizen as of June 17, 2024; and

🇺🇸 Have no disqualifying criminal history.

On March 16, 2022, Secretary Mayorkas from the Department of Homeland Security announced the designation of Afghanistan for Temporary Protected Status (TPS) for 18 months based on ongoing armed conflict & extraordinary & temporary conditions that prevent the country’s nationals from returning in safety. Only individuals who have already been residing in the United States as of March 15, 2022 will be eligible for TPS. TPS also provides for a work permit for this period.

Afghanistan is the 13th country currently designated for TPS. This is expected to affect at least 76,000 Afghans.

In order to qualify for TPS, an individual must:

🇦🇫 Be a national of the foreign country that has a TPS designation (or if stateless, have last habitually resided in a country with a TPS designation);

🇦🇫 Be continuously physically present in the United States since the effective date of designation;

🇦🇫 Have continuously resided in the United States since a date specified by the secretary of the U.S. Department of Homeland Security;

🇦🇫 Not have been convicted of a felony or two or more misdemeanors committed in the United States; and

🇦🇫 Not be barred from asylum for persecuting an individual, inciting terrorist activity, or other violations; or be found inadmissible under immigration rules for other criminal or national security reasons.

In response to ongoing armed conflict and extraordinary and temporary conditions in Ukraine that prevent nationals from returning safely, Secretary Mayorkas from the Department of Homeland Security announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months as of March 1, 2022. TPS also provides for a work permit for this period.

On August 24, 2021 USCIS announced that they will require COVID vaccines for green card applicants starting October 1, 2021.

"All applicants who receive their medical examination from a Civil Surgeon or Panel Physician on or after October 1, 2021 will be subject to this requirement and are encouraged to complete a COVID-19 vaccine series as soon as possible."

On February 18, 2021 Congress introduced the U.S. Citizenship Act 2021. The bill is a step forward to modernize our immigration system. The bill would provide a pathway to citizenship to 11 million undocumented Americans including DACA recipients, TPS holders and farmworkers who call this country home.

The bill also focuses on:
🗽 The root causes of migration
🗽 Remove barriers to family-based immigration
🗽 Restore asylum
🗽 Humane and effective border management
🗽 Replace “alien” with “noncitizen”

Federal Judge in Illinois just vacated the public charge rule in it’s entirety stating that it violated the APA.

Public Charge or Public Charge Test is used by immigration officials to decide whether a person can enter the United States and who is primarily dependent on the government for support. Under the new rule, people could be denied green cards, visas, and entry to the U.S. simply because they accessed public benefits.

The public charge rule impacted thousands of green card applicants. Applicants had to prove that they won’t be a public charge, or an “economic burden” to the country.

This is a huge victory for immigrants screens the United States.

On Monday, July 7, 2020 Immigration and Customs Enforcement (ICE) announced International students in the United States must leave the country or risk deportation if their universities decide to only offer online courses.

ICE said that students who fall under certain visas "may not take a full online course load and remain in the United States," adding, "The U.S. Department of State will not issue visas to students enrolled in schools and/or programs that are fully online for the fall semester nor will U.S. Customs and Border Protection permit these students to enter the United States."

This could affect more than one million international students currently studying in the US. According to the Institute of International Education, the vast majority of those students came from Asian countries, with the largest numbers by some distance coming from China 🇨🇳(369,548) and India 🇮🇳 (202,014). By contrast, only 26,122 came from Canada 🇨🇦(in fifth place) and 15,229 from Mexico 🇲🇽(in tenth place).

New York City 🗽 is home to the most international students, thanks to New York University and Columbia University playing host to 19,605 and 15,897 students respectively.
