Green & Schafle Partner Michael Schafle is honored to be assisting the Holland family with a nursing home neglect litigation effort.

The family of Marjorie Holland is deeply saddened by her passing and remains committed to understanding the circumstances that led to her tragic and unexplained injuries while under the care of Normandie Ridge nursing home. Her family was alarmed in February 2024 when they learned she had suffered several broken bones at the nursing home.

To support this effort, the family has retained attorney Michael Schafle of the Philadelphia-based law firm, Green & Schafle, who is actively investigating the events surrounding Mrs. Holland’s injuries and subsequent death. Mr. Schafle and his team are working diligently to uncover the truth, reviewing medical records, facility protocols, and witness accounts to determine what happened and whether proper care standards were followed.

“Our firm is committed to uncovering the truth about the tragic and unexplained injuries that led to Mrs. Holland’s death while under the care of the nursing home,” said Mr. Schafle. “Families place their trust in these facilities, and when that trust is violated, we will work tirelessly to hold the responsible parties accountable and seek justice for the victims and their loved ones.”

Green & Schafle Partner, David Carney recently obtained a rare and groundbreaking entitlement ruling in favor of an Arizona woman who developed dermatomyositis (DM)—a serious autoimmune inflammatory condition—following a seasonal influenza vaccination.

In a detailed and well-reasoned decision, the Court found that the flu vaccine was the most likely cause of Petitioner’s dermatomyositis, crediting the testimony of Petitioner’s expert, a renowned rheumatologist and immunologist from the University of California Davis.

The decision marks only the third time entitlement has ever been granted in a Vaccine Program case alleging DM, making it a significant legal milestone for individuals who suffer from the rare condition after vaccination.

David Carney, partner at Green & Schafle, wins $190K settlement in SIRVA vaccine injury case - setting a critical precedent for future cases.

David recently secured a favorable decision for a petitioner who suffered from a shoulder injury known as SIRVA (Shoulder Injury Related to Vaccine Administration) after receiving a vaccine in October 2020. The petitioner underwent extensive medical treatment for the injury, including two surgeries and multiple cortisone injections. Additionally, she attended 18 physical therapy sessions to help manage her pain and regain mobility in her shoulder. Despite a challenging legal battle, David litigated the case to the fullest by filing several motions demanding the court to decide on both entitlement and damages after the respondent presented a five-figure settlement offer. Ultimately, the court awarded the petitioner $190,000 for actual pain and suffering, recognizing the serious nature of the injury.

This decision is significant because it is one of the first in the National Vaccine Injury Compensation Program (VICP) involving SIRVA with two surgeries, setting a critical precedent for future cases.

In a recent vaccine trial in the National Vaccine Injury Compensation Program, David Carney, Esquire, represented a Brooklyn man who developed Guillain-Barre Syndrome (GBS) after receiving the TDaP vaccine in 2019. During the thorough and highly technical trial, David demonstrated through expert witnesses that the petitioner’s diagnosis was indeed GBS, which was caused by the vaccine.
