Case Update

This week, our team deposed Dr. Shaknovsky in the Turner case, the first deposition our firm has taken of him since his arrest in the Bryan matter.

The Turner case involves allegations that our client underwent an unnecessary surgery that resulted in a colostomy bag. During the deposition, our team questioned Dr. Shaknovsky about the necessity of the procedure and whether surgery was indicated. According to Joe, some of the testimony sounded familiar to other Shaknovsky depositions our firm has taken.

We also learned that GenesisCare had productivity-based financial incentives for physicians. Our team is investigating whether those incentives may have played a role in treatment decisions.

Additionally, we are filing a motion seeking punitive damages in the Bryan matter and a notice of intent against GenesisCare as we begin the presuit process.

Trial update.

On June 15th, we’ll be heading to trial in Santa Rosa County in a case involving allegations against Gulf Breeze United Methodist Church and the Methodist Conference related to the hiring, supervision, and oversight of a youth pastor accused of sexually abusing our client when she was 13 years old.

Today was the pretrial conference, where the court heard motions, handled procedural issues, and continued preparing the case for trial. This lawsuit was originally filed in 2022, and after years of litigation, we are finally moving toward trial.

As always, these are allegations and the defendants will have the opportunity to present their side in court. The jury will decide the case based solely on the evidence presented in the courtroom.

The court has approved cameras in the courtroom, so we’ll be bringing you updates and footage throughout the trial process as we continue to educate the public on how the civil justice system works.

Quick update on the Williams case:

Progressive appealed the nearly $3 million verdict after the Santa Rosa County jury found in favor of our client.

Today, the case was PCA’d, meaning the appellate court affirmed the trial court’s decision without issuing a written opinion.

This case involved a woman who suffered a traumatic brain injury after a crash involving a driver with only a $25,000 policy.

Now, the ball is back in Progressive’s court.

🚨 Did you see what happened at Fairfield & I-10 last Friday night? 🚨

We’re investigating a crash that occurred around 8:40 PM on April 24 at the intersection of Fairfield Drive and the I-10 on-ramp, an area known for confusion regarding the traffic light and turning patterns.

Our client was turning left onto the on-ramp and believed she had the right of way. We contend the eastbound vehicle failed to stop at a red light, causing the collision. The responding trooper spoke with a witness, but they were unable to confirm the status of the light.

What happens when a successful cancer surgery turns into a tragedy?

We are currently litigating a medical malpractice wrongful death case involving HCA Florida West Surgical Specialists. After a successful Whipple procedure to remove suspected pancreatic cancer, our client’s prognosis was excellent, all tests came back negative for cancer.

However, our allegations center on what happened next. We allege that post-operative care was dangerously overlooked. Amylase, a powerful digestive enzyme allegedly leaked into the abdominal cavity. Despite the patient being hospitalized for a month, he wasn’t tested for this leak for 26 days. By then, levels were 500 times the normal concentration, causing irreversible tissue damage.

The defense claims the damage was caused by scar tissue, not an enzyme leak. We are now in the deposition phase, where we continue to lock in testimony. As always, these are allegations, and the final facts will be determined by a jury.

What does it actually mean that ma*****na was reclassified from Schedule I to Schedule III?

This morning, Attorney General Blanche reclassified ma*****na under the Controlled Substances Act moving it from a category with “no accepted medical use” (like he**in and L*D) to one that recognizes medical use.

From a medical standpoint, that shift acknowledges ma*****na as having accepted treatment value.

From a legal standpoint, it’s a big deal. For years, federal law conflicted with states like Florida that already recognized medical ma*****na creating issues with banking, research, and regulation.

This change could impact how ma*****na is studied, funded, and handled at a federal level moving forward.

What did Ron DeSantis just change for drivers in Florida?

Happy Friday. Governor DeSantis was busy signing several new laws, including what’s being called Isaiah’s Law. This adds to Florida’s habitual traffic offender statute by targeting people who repeatedly drive without a valid license. With a certain number of convictions (around three within five years), it can now lead to mandatory jail time and up to five years of revoked driving privileges, meaning you can’t get a license even if you wanted to. The goal is to address the growing number of unlicensed drivers on Florida roads and create stronger consequences for repeat offenders.

Why are there both a civil case and a criminal case in situations like this?

Our system provides two different paths to justice. The criminal case is about punishment, making sure what happened is addressed under the law. The civil case is about accountability, making sure the family is compensated for their loss, suffering, and everything they’ve endured.
