My friend Eric Stevenson associated me on this Jackson County, MS case since I practice in MS as well as AL and FL. After briefing and oral argument, we were able to demonstrate that a dismissal of the charges was warranted based on 4th & 5th Amendment issues concerning the evidence.

He was charged in Mississippi for taking guns involved in the murder and robbery of Byrd and Melanie Billings.

Good synopsis of the recent NJ case on the inherent unreliability of eyewitness testimony. Over the last 15 years I have worked with several national experts on the ID iissue and it is nice to see courts recognizing what the experts have bee saying for so many years. ID testimony can be very unreliable.

The New Jersey Supreme Court, acknowledging a “troubling lack of reliability in eyewitness identifications,’’ issued sweeping new rules yesterday making it easier for defendants to challenge such evidence in criminal cases.
