On June 7, the DOS announced that effective June 9, 2025, the DOS is suspending visa issuance to nationals of Afghanistan, Burma, Chad, Republic of the Congo, Equatorial Guinea, Eritrea, Haiti, Iran, Libya, Somalia, Sudan, and Yemen for all visas except for certain itemized categories; and is partially suspending visa issuance to nationals of Burundi, Cuba, Laos, Sierra Leone, Togo, Turkmenistan, and Venezuela for nonimmigrant B-1/B-2 visitor visas and F, M, and J student and exchange visitor visas, and all immigrant visas with limited exceptions.

Sultanov, holding that the search of an electronic device at the border is a non-routine search that falls outside of the border search exception, and that such a search requires a warrant and probable cause pursuant to the Fourth Amendment.

We are living in exciting times for the world of American immigration! The new BIDEN PIP announcement on June 17, 2024 is set to start receiving applications as of August 19. The Applicant must demonstrate that on June 17, 2024:
• Present in the United States without admission or parole;
• Had been continuously present in the United States for at least 10 years;
• Had a legally valid marriage to a U.S. citizen as of June 17, 2024;
• Not have any disqualifying criminal history or otherwise constitute a threat to national
security or public safety; and
• Otherwise merit a favorable exercise of discretion.

President Biden has announced a new immigration plan which includes a new process for certain noncitizen spouses and children to obtain residence without leaving the country. The noncitizens must – as of June 17, 2024 – have resided in the United States for 10 or more years and be legally married to a U.S. citizen, while satisfying all other applicable legal requirements. The process should be implemented in late summer!

The USCIS has published a temporary final rule providing that the automatic extension period for expiring EADs for certain renewal applicants who have filed Form I-765 will be increased from up to 180 days to up to 540 days. This increase applies to certain renewal applicants with pending Forms I-765 as of 5/4/22, including those applicants whose employment authorization may have lapsed following the initial 180-day extension period, and any eligible applicant who files a renewal Form I-765 during the 540-day period beginning on or after 5/4/22, and ending 10/26/23.
