🇺🇸 NEW USCIS MEMO — Don’t Panic, Get Prepared
📄 There are reports from recent marriage-based AOS interviews showing that USCIS officers are now asking new questions connected to the recently released memorandum.
These include:
1️⃣ Why did you apply for Adjustment of Status instead of Consular Processing?
2️⃣ Are there any factors preventing you from pursuing Consular Processing?
3️⃣ Do you have family still living abroad?
4️⃣ Why did you decide not to return to your country when your authorized stay expired?
Additionally, new Requests for Evidence (RFEs) are asking applicants to show positive factors that justify a favorable exercise of discretion — such as family ties, long residence, education, employment, community service, and proof of income (tax returns, W‑2s, bank statements, employer letters).
💡 Don’t panic — just get prepared.
This memo signals a stricter review process, but it doesn’t change the law. It means USCIS is emphasizing documentation and discretion.
