Community matters to us at Brooks Law Partners. We were proud to sponsor the 6th Annual Race for FATE 5K, 2K & Kids Fun Run supporting programs at Fred A. Toomer Elementary.

This event brings families, educators, students, and local supporters together for something bigger than a race. It is an investment in children, education, and the future of our community.

We were especially proud to see one of our incredible attorneys, Sarah Adle, serve as the MC for the event. Sarah helped form the Fred Armon Toomer Elementary Educational Foundation in 2016 and currently serves as Chair of the Board of Directors. Her dedication to this school and its students is something we deeply admire.

Supporting the communities we serve has always been important to our firm. We are grateful to be part of events like this that bring people together and create meaningful opportunities for local students.

Every parent has been there.

You’re standing at the trampoline park counter reading a three-page waiver and your kid is already taking their shoes off to jump. If you put up too much of a stink, suddenly they can’t go.

So what do you do? Most of the time, you sign it.

In Georgia, waivers can cover risks like the ordinary bumps and collisions that happen when kids are playing. But not everything can be waived, like gross negligence.

When there is reckless conduct and intentional disregard for safety, that waiver may not protect them.

Signing a waiver doesn’t always mean you gave up every right.

Mediation strategy matters.

Most mediations begin with numbers that are far apart. Brackets help move negotiations forward. When negotiating brackets, the midpoint is important, but don’t loose sight of the top and bottom numbers because you don’t want there to be overlap.

Once brackets overlap, the expectation is that is where the case will settle. When that expectation forms, it can be very difficult to move the number.

Thoughtful strategy preserves negotiating space and helps keep the conversation moving toward a meaningful resolution.
