🐾 MYTH vs. FACT with Henry!

❌ MYTH: “I have a will, so I’m good to go.”

✅ FACT: A will is an important part of estate planning, but it may not be the whole plan.

A comprehensive estate plan can include wills, trusts, powers of attorney, advance health care directives, Medicaid planning, and asset protection strategies.

Estate planning is not only about what happens after you’re gone. It can also help protect you, your family, your assets, and your wishes during your lifetime.

Whether you already have a will or are starting from scratch, it may be worth asking: Does my estate plan cover the whole picture?

📍 Robert M. Goldberg & Associates helps families with estate planning and elder law throughout Atlanta, Peachtree City, Zebulon, and communities across Georgia.

It’s Not Too Late

Your parent is already in a nursing home. Now what?

Maybe the family thought they had more time.

Maybe the health crisis came suddenly.

Maybe nobody realized how quickly long-term care could drain a lifetime of savings.

And now someone is saying, “You need to apply for Medicaid.”

That’s when panic sets in.

But needing care now does not necessarily mean Medicaid planning is no longer an option.

Medicaid crisis planning is designed for situations where long-term care is already happening or right around the corner. There may still be strategies available to help protect assets and navigate Medicaid’s complex eligibility rules.

The important thing?

**Don’t start moving money or giving assets away on your own.** Medicaid has strict rules, including a 5-year lookback period, and the wrong move can create a bigger problem.

If your family is facing a nursing home crisis, get legal advice before making financial decisions.

At Robert M. Goldberg & Associates, we help families understand their options and navigate Medicaid planning, even when the need for care is immediate.

Dorm supplies? Check. Class schedule? Check. Essential legal documents? Don’t forget those.

Once your college-bound child turns 18, you may no longer have the automatic legal authority to access medical information or step in during an emergency. Our Back-to-School Package helps young adults put the right documents in place before heading to campus, giving the whole family greater peace of mind.

Between packing snacks, dorm essentials, and way too many hoodies, there's one thing every family should add to the college checklist.

Once your student turns 18, parents can't automatically access medical information or make medical decisions in an emergency.

That's why a Health Care Power of Attorney, HIPAA Release, Living Will, and DocuBank I.C.E. card are some of the most important things they can take to campus.

Don't wait until an emergency to realize you're missing them.

Mom is in a nursing home rehab. Now what?

This is one of the most stressful moments families face.

A parent goes to the hospital. Then rehab. Then the family hears words like:

"Medicare days are ending."
"Private pay may be required."
"You may need to apply for Medicaid."
"The nursing home bill could be thousands each month."

That is when the wolf is at the door.

The wolf is not paperwork. The wolf is the possibility of spending a lifetime of savings on nursing home care without first understanding what Georgia law may allow the family to protect.

Before you spend down assets, transfer money, pay large bills, or file a medicaid application, pause and get legal guidance.

A few important questions:
- Who has the legal authority to act for Mom or Dad?
- Is there a valid financial power of attorney?
- Is there a valid health care directive?
- Is the spouse at home protected?
- Are there assets that need to be reviewed before spending?
- Is a Qualified Income Trust, aka Miller Trust, Needed?
- Has the family received clear advice?

If your loved one is in rehab, in a nursing home, or may need nursing home care soon, schedule a Medicaid Discovery Meeting.

But there's one thing almost every family forgets before move-in day.

If your son or daughter is heading off to college this fall and has recently turned 18, you'll want to read this.

Our newest blog covers one of the most overlooked items on every college checklist and why it could make all the difference in an emergency.
