Establishing Paternity, Legal Custody, and Parenting Time.
When a child is born outside of marriage, the law provides sole legal and physical custody to the biological mother. If the parents signed a Minnesota Voluntary Recognition of Parentage form, the father may petition the Courts to establish legal custody and parenting time. If a ROP was not signed, the father must establish paternity prior to petitioning the Court to establish legal custody and parenting time. The law provides several rebuttable presumptions that a man is presumed the biological father of the child in Minnesota Statute § 257.55. If you are interested in establishing paternity, legal custody, or parenting time of your children, please contact our office.
