Maryland automatically charges more teens as adults than almost any other state. An analysis of recent decisions found that some judges rely on what juvenile justice advocates say is unfair reasoning to keep those young people in adult court.

Ortega Law’s Windy Ortega testified before the Senate Judicial Proceedings Committee on February 16, 2023, in support of Senate Bill 93—the Youth Equity and Safety (“YES”) Act. As one of the leading practitioners of Juvenile Criminal Defense in the community, Windy spoke on her experiences working with juvenile offenders and the juvenile justice system. The YES act would alter the structure of the juvenile justice system, ending the longstanding statutes that requires juveniles over a certain age and accused of certain crimes to be charged as adults. Particularly compelling was Windy’s testimony regarding her high success rate in having juveniles charged as adults transferred to the jurisdiction of the juvenile court. Originating these cases in juvenile court would drastically reduce the time needed to resolve charges brought against juveniles and be in the best interest of justice.

Windy spoke on behalf of the MCDAA who “sees this legislation as one of the most important and far-reaching bills in the 2023 session.” Ortega Law is very proud that Windy Ortega was able to speak on behalf of the bill that would so greatly benefit the community that we serve.
