Lawson v. PPG Architectural Finishes, Inc. promised to be a game-changer for employees filing Labor Code § 1102.5 claims. But has it been?

Below, we share Ramit Mizrahi's article on this topic, published in the November 2022 issue of the California Labor & Employment Law Review. The article examines all published and unpublished California and federal appellate decisions and federal district court cases that addressed Labor Code 1102.5 claims post-Lawson through mid-October. The results suggest that defendants continue to prevail on summary judgment, and some courts may be treating the first step in the sections 1102.5/1102.6 analysis as creating a heavier burden than the first step in the McDonnell Douglas test. If so, the benefits of section 1102.6 to plaintiffs may largely be neutralized, contrary to the intentions of the California Legislature in enacting it.

Ramit Mizrahi was interviewed by KCRW on the topic of mandatory vaccines back in February. The story finally aired yesterday! There is much more nuance to things, but yes! Employers CAN mandate vaccines. Workers with disabilities or sincerely-held religious beliefs that prevent them from being vaccinated may be entitled to reasonable accommodations (e.g., remote work, segregated workspaces, etc.) if they can be provided without creating an undue hardship to the business or direct threat to other workers. Unionized workplaces are a little more complicated. And, with the new CDC guidelines, and full authorization of the vaccines forthcoming, we expect more and more workplaces to mandate vaccines.

Silverado, a long-term care facility chain with the majority of its locations in Southern California, started requiring COVID vaccines for employees starting March 1.
