Defeated a summary judgment motion for my client, an executive who worked for Becton Dickinson for 25 years and brought an age discrimination case after a new supervisor terminated him for "poor performance," then replaced him with someone substantially younger. Court agreed that we have sufficient evidence to proceed to trial.

Over the last few years, I have been doing a lot of counseling on non-compete agreements, especially for professional women. I have seen a common

On a break from our trial in the case of Kimberle Malta-Roman vs. Hudson County. We were very gratified by the jury's recognition of the harm that Hudson County caused Kimberle and their award of $2.45 million. We're now heading into the punitive damage phase of the case, so there may be more news to come.

Learned yesterday that the Court denied Mars Inc's motion for summary judgment in our age discrimination case. The Court found that there was evidence that my 61-year old client had performed well in the past and a new manager targeted her for termination and replaced her with a 21 year old with no experience. Also, there was evidence that the manager rated other women in their 60s poorly and only hired people in their twenties and thirties. Going to trial in a few weeks.

Congratulations to my partner, Stewart Leviss on being named to the New Jersey Top 100 Lawyers ranking by Super Lawyers. In addition to being a great guy and a pleasure to work with, Stew is a Certified Civil Trial attorney and specializes in commercial, personal injury and medical malpractice litigation. Recent victories include a 7-figure recovery in a construction dispute, a high 6-figure recovery for the survivors of a man misdiagnosed at the emergency room after an auto accident and a mid-6-figure recovery against a school in a student bullying case.

Great day today! Defending an individual in a non-compete case. My client was terminated allegedly for not producing enough sales. We believe it was because the employer was trying to avoid paying commissions and bonus and in retaliation for complaints of harassment and discrimination. Even though she was terminated, the employer demanded the court prohibit her from providing any services to clients - even clients that went to her voluntarily. The court denied the injunction and refused to issue any restraints.
