1. YOU CAN REFUSE TO TAKE THE FIELD SOBRIETY TESTS: An officer will make you do the following tests; Horizontal Gaze and Nystamgus Test (commonly referred to as the eye test), the One-Leg Stand test (typically an individual lifts one leg up for a count of 30 seconds), and the Walk-and-Turn test (usually an individual walks heal to toe on a straight line, walking 9 steps forward and 9 steps back). If an officer starts conducting any of these tests, then you can tell the officer, “I REFUSE ANY TEST.”
2. YOU CAN REFUSE TO TAKE THE BREATH TEST: If an officer requests that you take a breath test on the street or at the police station (this is a machine that based on your breath sample will indicate if your blood alcohol level is over .08), then you can tell the officer, “I REFUSE THE BREATH TEST.”
Refusing the field sobriety test and breath test will not prevent the officer from arresting and charging you with a DUI offense, or prevent the suspension of your license. However, the refusals DO HELP your attorney in developing your defense to the DUI offense and/or suspension of your license.
