Well this is good news, and all the luck of the Irish to you, today! 🍀 Together with a fun fact from Market Briefs, a service I love (thank you, Amanda!) but have been opening with a side eye, lately. If you are watching the market or watching interest rates, they always have a daily break down. Today’s daily rate is disappointing, but I’m seeing better and am hopeful that we will continue to see better, given everything else. Why is it alarming that most have lower interest rates than current? Well, among other things, if their rate is adjustable, the next adjustment will be a potentially life-changing shock. Good news is that mortgages {home loans} generally always have a 2% cap. But even that can be too much for many in a down economy.

So we know the Fed raised the rates slightly this week, but there is good news: a decrease in mortgage rates—and we are seeing that play out. While no one has a magic ball, this is the best we’ve seen in a number of months so if you’ve been waiting, now may be the time!

Also being a business woman, I always think of January as entity month, so here’s your friendly reminder. When getting all the end-of-year records to your accountant, go ahead and do your entity check, too, especially because this is an area where the real estate world is seeing a great deal of fraud. Make sure you: 1) know where your book is; 2) have your yearly meeting reduced to paper and placed in your minutes; 3) if your entity owns real estate, check the CAD in your area and pay those taxes by Tuesday—I say check, meaning, make sure it’s in the correct name; and 4) ensure that those running your entity are the approved managers and officers, both in the book and with the Secretary of State. Do you have to file with the SOS? No, but here’s where the new fraudsters look for the vulnerable, so the BEST Practice is to do it and check it periodically. Also, while you are at it, make sure you aren’t forfeited, and if you are, get reinstated, quick!

-- QUIT the QuitClaim Deeds (QCD).

Most of the US conveys title by QuitClaim, but Texas is, of course, different. The good news is that the legislature dealt with this in September of 2021. The bad news for many is that the law doesn't make QCD's immediately effective, but they are effective 4 YEARS after recording. Most people don't want to wait 4 years to make profitable use of their land. The easier thing is to have a knowledgeable real estate lawyer prepare you a Warranty Deed. Otherwise, you'll likely be stymied on your next Real Estate deal.

Here's a flyer put together by the Texas Land Title Association, red lined by your's truly. Note that the law doesn't help those who received conveyance by QCD before 9-1-2021.
