Fathers: Do you understand how your child support is calculated?

California does not simply assign a child support amount based on your salary.

Two of the biggest factors are:

Your income and your parenting timeshare.

A significant difference in either one can change the guideline calculation.

Health insurance, mandatory retirement contributions, union dues and tax settings can also affect the result.

And even if you have 50/50 custody, you may still have a child support obligation.

Potentially.
California guideline child support is presumptively correct, but courts have authority to deviate in appropriate circumstances.
That does not mean simply telling the judge, “I can't afford it.”
The evidence matters.
We look at the guideline calculation, net spendable income after support, an accurately completed Income and Expense Declaration, and necessary living expenses.

We hear that frequently from fathers.
California does not automatically require 50/50 parenting time, but fathers are not automatically limited to alternating weekends either.
The real question is what parenting arrangement serves the child’s best interest.
Where do the parents live? How far apart are they? Where does the child attend school? What are Dad’s work hours? What has his involvement with the child actually been? How will transportation and activities work?

If you have joint legal custody, can the other parent make important decisions about your child without you?
The answer may depend on what your custody order actually says.
Joint legal custody involves decisions concerning your child’s health, education and welfare—but it does not necessarily mean both parents must agree on every decision.
What if you disagree about school? Medical treatment? Counseling? Can one parent receive final decision-making authority while joint legal custody otherwise remains in place?
Fathers should understand exactly what their custody order provides, not simply whether the box marked “joint legal custody” is checked.

We hear this frequently from fathers during custody consultations. But “full custody” is not really a California legal term.

What are you actually asking for?

Sole legal custody? Sole physical custody? More parenting time? Supervised visitation for the other parent? Or authority to make a particular decision involving school or medical care?

As a practical matter, joint legal custody is common in California. Simply not getting along with the other parent generally does not answer why one parent should have sole legal custody.

The court is focused on the child’s best interest.

A domestic violence finding can change a California child custody case immediately.

For fathers involved in a custody dispute, it is important to understand Family Code section 3044. A qualifying finding of domestic violence within the previous five years can create a rebuttable presumption against awarding the person found to have committed domestic violence sole or joint legal or physical custody.

And domestic violence does not necessarily mean physical violence. California law recognizes a broader range of conduct that can potentially support a domestic violence finding.

At the same time, an allegation is not the same thing as a finding. Evidence and credibility matter.

The other parent says she wants to move away with your child. Can you stop the move?

In a California move-away custody case, one of the first questions we ask is: What is the existing parenting timeshare?

That can determine the legal standard and who has the burden of proof.

If you genuinely share physical custody, Burgess footnote 12 may require the court to make a new determination of what custody arrangement is in the child’s best interest after the move.

If the other parent is the established primary custodial parent, however, simply objecting to the move is generally not enough. The parent opposing relocation typically has the initial burden of demonstrating detriment to the child.

A lot of fathers walk into CCRC believing the session is simply about proving the other parent is wrong.

That is usually a mistake.

In Riverside and San Bernardino County, the recommendation coming out of Child Custody Recommending Counseling can significantly affect the outcome of a custody case. Counselors are often paying very close attention to:

* communication
* emotional regulation
* co-parenting ability
* credibility
* and which parent appears more likely to support the child’s relationship with the other parent moving forward.

One of the biggest mistakes parents make is spending the entire session focused on the other parent’s dating life, significant other, or generalized complaints that may have little relevance to the actual custody issues before the court.

A 730 custody evaluation can completely change the direction of a custody case.

A lot of parents walk into these evaluations believing they need to convince the evaluator they are the “perfect parent” while the other parent is completely at fault. That is usually NOT how evaluators think.

In many high-conflict custody cases, evaluators are looking closely at:
• credibility
• emotional regulation
• co-parenting ability
• restrictive gatekeeping concerns
• visitation refusal dynamics
• communication patterns
• and which parent is more likely to support the child’s relationship with the other parent.

Not every case requires a full 730 evaluation. Some disputes, especially move-away cases, may end up in a more limited Family Code section 3111 evaluation.
