đ When you are in a CAR WRECK, Kentucky is a no-fault state and SO MANY PEOPLE misunderstand or misstate what this means. Please read and share. đĽ
No-fault in Kentucky doesnât protect bad drivers.
It protects injured people from delays.
Your insurance pays first.
The at-fault driver can still pay later.
Kentucky follows a no-fault system, which means:
* After a car accident, your own insurance pays your medical bills and certain lost wages, no matter who caused the crash.
* This coverage is called Personal Injury Protection (PIP).
What PIP covers
Your PIP benefits typically cover:
* Medical expenses
* Lost wages (a portion)
* Some out-of-pocket costs related to the injury
In Kentucky, the basic PIP coverage is $10,000 per person.
âNo-faultâ does NOT mean fault doesnât matter. It just means:
* You start with your own insurance for quick payment
* Fault becomes important later if the case escalates
Kentucky allows you to pursue a claim against the at-fault driver if your case meets certain thresholds:
You can step outside no-fault if:
* Medical expenses exceed $1,000, OR
* You suffer certain injuries (like fracture, permanent injury, disfigurement, etc.)
At that point, you can pursue:
* Pain and suffering
* Full lost wages
* Other damages
Fault still matters. It just comes into play after the initial PIP layer is exhausted or the threshold is met.
After a crash in Kentucky, Momma Bear doesnât wait around arguing about fault.
She makes sure her cub gets care immediatelyâthatâs no-fault.
But if someone hurt her cub?
You better believe accountability is coming next.
