Bankruptcy. Many ask whether in a bankruptcy they will lose a car or a house. Often they think a chapter 7 will cause the loss. However, Congress created a list of property you can keep and the often put dollar limits on the maximum values. If your house equity is less than a certain dollar amount, say $25.000 per person, the Federal Exemptions will allow it to be kept. There are also State Exemptions in Michigan. The Bankruptcy Code allows you to keep property to help you with a fresh start. Some of the categories are house, car, jewelry, household goods, pets, retirement. Sometimes you can keep it all (retirement usually) and sometime you have limits ($12K for household goods for instance).

If you try to save assets by putting them in the name of someone else, you may actually lose the asset when you could have originally kept it in a bankruptcy. That is because you are entitled to "exempt" the property you need for a fresh start. Once it is in someone else's name, you no longer have ownership, so you no longer can complain about a court order to surrender this item such as cash, a car or a house
