Last week, I was asked to participate in a symposium put on by the largest workers’ compensation defense firm in the area. Along with one of their senior partners and a Kansas Administrative Law Judge, we addressed key issues for hundreds of claims representatives and employer workers’ compensation coordinators. The basic message I had for them was to stop playing games against injured workers. Of course they should investigate reported accidents and claimed injuries, but there is a legitimate way to do so while not causing unnecessary delays and confusion. From their end, this avoids costly and unnecessary litigation. More importantly, it helps to prevent undue hardships for the injured worker in need. We’ll see if any of them get the message. If not, feel free to call us to find out what they SHOULD be doing.

In my opinion, its: Kansas legislature to injured workers: "Go Screw Yourself!" After having to turn away so many previously compensable claims because of these new laws, I find these new laws to be immoral, not just inconvenient.

This is getting ridiculous! I hear from employers all the time what they think of workers compensation. They say its a drag on business, on the economy. Its amazing how many of those same business owners (and opposing claims representatives) have sent their wives or daughters or sons, or other family members to this firm when they are injured. In our entire careers, we have never gotten a person ANYTHING that the states of Kansas and Missouri haven't already said they have coming to them. Not one dime more. But we have gotten hundreds, if not thousands of people more benefits than their employers and/or insurance carriers were willing to pay voluntarily.

This bill will continue the downward trend of benefits to hard working men and women injured in Kansas and will continue to play "gotcha" with people who are not familiar with the rules. Its shameful.

Today the Kansas Senate will debate Senate Bill 73 on the floor. SB 73 proposes to shift worker’s compensation from the current system to a system that would favor the employer over injured workers all across Kansas. SB 73 seeks
