Lots of people call and tell us things like "I just want to do a deed to give my real estate to my children." Potential clients think it is a simple transaction. We tell them that we need a lot of information before we are willing to assist them with that project. Sometimes people get angry and can't understand why we won't just draft a deed without knowing all of their additional information. However, our advice is only as good as the information we have. A "simple" deed to children can have serious consequences with respect to Medical Assistance eligibility, estate taxes, gift taxes, and income taxes. Other serious problems can occur if a child dies, gets divorced, or has financial difficulties. We want clients to go into these transactions knowing all of the consequences and making an educated decision. Often people do not realize the other options that are available. It may be that a deed is all they need but we can't help them know all of the consequences and make an educated decision if we don't know all of the facts! We bill on a flat fee basis, so if people only need a deed that’s what they get charged for. But we will never just draft a deed without knowing someone’s entire situation! Otherwise, we wouldn’t be doing a good job! Everything we learn is kept confidential.

PUBLIC SERVICE ANOUNCEMENT: If you get a letter from a research company reminding you to file your annual MN LLC renewal and telling you to pay them $55 to do so, don’t! You can complete your renewal online for free in less than five minutes at the MN Secretary of State’s website. If you forget and have to reinstate your company, currently the SOS’s office charges $45 to do so, which is less than this company is charging to take care of filing that free annual
renewal for you. (This is a copy of a letter they sent to remind us to file our law firm’s LLC annual renewal.)
