Free Advice Friday’s at Monarch are full of little nuggets like this.

We talked about Earnest money deposits going hard and how to protect them so that they aren’t stuck in contested purgatory.

Here’s the secret. Don’t leave EMD release to interpretation. Your contract needs unilateral release language at the sole discretion of either buyer or seller, depending on your side. Otherwise who decides if there’s been a breach? Contested EMD, every time. The magic isn’t in the intention, it’s in the contract language. That’s what we drill in Free Advice Fridays.

The worst part? Most people in those transactions didn't even know there was a problem until it was too late and even if they did know they had no idea what to do about it.

FinCEN Update:

Just As Things Were Going Smoothly... Isn't That How It Always Happens?

FinCEN has been challenged and, as of today, it's fate uncertain.

Two Federal District Courts have considered challenges to FinCEN with differing results.

On February 19, 2026, the Middle District of Florida in the case of Fidelity v. Bessent ruled in favor of FinCEN.

On March 19, 2026, the Eastern District of Texas in the case of Flowers v. Bessent, ruled against FinCEN and vacated the RRE Rule.

With these differing decisions, we can expect appellate courts to become involved. With the significant impact of this uncertainty and looming filing deadlines, there likely will be developments to report prior to April 30th when filings are due for any closings which occurred in March.

In the meantime, real estate professionals are strongly encouraged to continue to collect required information and prepare reports, but delay reporting until more information on the impact of the split among district courts is available.

For instance, just as with the BOI reporting, the latest court ruling may be stayed pending appeal in which case reporting would resume. Without the required information already collected, reporting could become a liability.

Monarch Meaning: Life Estate

A life estate means someone has the legal right to live in a property for the rest of their life, but they may fully own it depending on how the deed was drafted.

Two key players:
• Life tenant – lives in the property for life
• Remainderman – gets the property after. Think of it like a fancy word for heir.

Here’s where it matters: not all life estates work the same.

→ Some require both parties to sign to sell
→ Others (like enhanced life estates) allow the life tenant to sell during their lifetime
→ The difference is all in how the deed was drafted

Translation: if you see “life estate,” don’t assume; verify.
