🐾 Let’s Talk About Support Animals in Florida Rental Housing

One question I hear from landlords is:

“My property is no-pets. Can I refuse a tenant’s emotional support animal?”

The answer is: not necessarily.

Under the Fair Housing Act and Florida law, an assistance animal is not considered a pet when it is needed because of a person’s disability. A tenant may request a reasonable accommodation to keep an assistance animal, even when the property has a “no pets” policy. (HUD⁠)

🏠 For landlords:
• A blanket “no pets” policy does not automatically allow you to deny an assistance animal.
• You may request reliable information supporting the disability-related need when the disability or need is not apparent.
• An internet registration, certificate, ID card, or vest by itself is not sufficient to establish the need for an emotional support animal under Florida law. (Florida Senate⁠)
• Pet fees or pet deposits generally cannot be charged for a qualifying assistance animal. (HUD⁠)
• A request may potentially be denied when the animal presents a direct threat to health or safety, or a direct threat of property damage, that cannot be reduced or eliminated through another reasonable accommodation. (Florida Senate⁠)
• The tenant remains responsible for damage caused by the animal. (Florida Senate⁠)

📌 Important: Service animals and emotional support animals are not exactly the same thing, and different laws can apply depending on the situation.

As a Realtor® and Property Manager, I believe it is important for both landlords and tenants to understand their rights and responsibilities before making decisions about assistance animals.

When in doubt, consult a qualified Florida attorney or Fair Housing professional before denying an accommodation request.
