Recuerda: Si eres Residente legal Permanente (LPR) y vas a viajar fuera de los Estados Unidos, tu tarjeta de residente (green card) debe estar valida al día en que vayas a volver a entrar a los EEUU.

Recuerda: Toda persona con green card o visa que le autorice a viajar a los EEUU, cada vez que viaja fuera de los EEUU, la decisión
final de autorización de entrada esta en las manos del oficial de inmigracion del U.S.C.B.P.

Entonces: No viajes fuera de los EEUU si haz tenido encuentros con la ley (arrestos, cárcel, DUIs, etc.) sin antes hablar con tu abogado/a de inmigracion.

Duración del viaje: Si el LPR va a viajar fuera de los EEUU por un tiempo de 180 o mayor a 180 días, deberá obtener autorización de la USCIS para poder entrar (Form I-131).

PUBLIC CHARGE FINAL RULE ANNOUNCED

From the USCIS webpage:

Alert: On Sept. 8, 2022, DHS announced a final rule that will implement the public charge ground of inadmissibility. The final rule will be effective on Dec. 23, 2022, and will apply to applications postmarked (or electronically submitted) on or after that date. Until the effective date of the final rule, USCIS will continue to apply the public charge ground of inadmissibility consistent with the 1999 Interim Field Guidance. The USCIS is no longer applying the August 2019 Public Charge Final Rule. As a consequence, among other changes, USCIS will apply the public charge inadmissibility statute consistent with the 1999 Interim Field Guidance.

Applicants for adjustment of status should not submit Form I-944, Declaration of Self Sufficiency, or any evidence or documentation required by Form I-944 when they file their Form I-485. Applicants and petitioners for extension of nonimmigrant stay and change of nonimmigrant status should not provide information related to the receipt of public benefits on Form I-129 (Part 6), Form I-129CW (Part 6), Form I-539 (Part 5), and Form I-539A (Part 3).

If USCIS requires additional information or evidence to make a public charge inadmissibility determination under the statute and consistent with the 1999 Interim Field Guidance, we will issue another RFE or NOID.

IMPORTANT - IMMIGRATION: TPS for Ukrainians in the USA as of March 1, 2022.

Individuals eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022. Individuals who attempt to travel to the United States after March 1, 2022, will not be eligible for TPS.

The Department of Homeland Security (DHS) announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months.
