When people find themselves in jail, one of the first questions is often: “How do I get out?”

Understanding the difference between bail and a bail bond can help you navigate the process. Bail is the amount set by a judge to help ensure someone returns for their required court dates. A bail bond is an assurance from a bondsman to pay the bail amount if the person fails to appear.

Domestic violence battery can involve more than just hitting. Pushing, grabbing, slapping, choking, biting, or holding someone against their will can all lead to criminal charges.

In Florida, domestic violence battery is generally a first-degree misdemeanor, punishable by up to 1 year in jail and a $1,000 fine, along with additional requirements such as a 26-week domestic violence course and 12 months of probation.

When a weapon is involved, the charge can be elevated to aggravated domestic battery, a second-degree felony punishable by up to 15 years in prison.

Facing a domestic violence charge? Contact O’Mara Law Group to learn about your legal options.

- Dating violence: for violence or threats involving a dating or intimate relationship

- Sexual violence: for victims of sexual violence, including sexual battery
- Stalking: prohibits active stalking or cyberstalking
