🚨 WAIT—DOES CONGRESS EVEN HAVE THE CONSTITUTIONAL POWER TO BAN NONCITIZENS FROM VOTING?

That’s the question a federal judge in South Florida just confronted—and the opinion is a thrilling read for anyone who loves constitutional law. Sharp, direct, and a reminder that sometimes the most important legal question is not whether government should do something, but whether the Constitution gives that particular government the power to do it.

And NO—the court did not say noncitizens have a constitutional right to vote.

The issue is far more interesting:

⚖️ Congress can regulate HOW federal elections are conducted. But can Congress decide WHO is qualified to vote?

The judge says the Constitution largely leaves voter qualifications to the states and held the federal criminal prohibition unconstitutional as applied in this case.

For immigrants, however, do not mistake this ruling for permission to vote.

🚫 Florida still prohibits noncitizen voting.
🚫 Unlawful voting can still carry serious immigration consequences.

This opinion sits at the intersection of immigration, federalism, criminal law, and election law—and it is one of those decisions that reminds lawyers why constitutional law can be so fascinating.

HOW vs. WHO.

Such a simple distinction. Such a massive constitutional question.

⚖️ And kudos to Judge Leibowitz for an opinion that is not only thought-provoking, but genuinely thrilling to read.
