In some cases, after the plaintiff hires our law firm, we can resolve the dispute prior to filing a lawsuit, saving our clients time and money. If the defendant fails to abide by the terms of the contract, we file a lawsuit on behalf of the plaintiff. The majority of civil lawsuits settle prior to trial. If settlement is not reached, we will take your case to trial and aggressively fight for a judgement in your favor. We also represent clients in the administration of formal, summary, and ancillary administrations of a decedent's estate. When a loved one passes away, we counsel the petitioner (in a summary administration) or the executor, known as the personal representative in Florida (in formal and ancillary administrations) in the administration of the estate. The probate process is complex as no two probate administrations are the same. We realize that you are grieving the loss of a loved one and understand that the administration of the estate can cause further stress. Our Law Firm will file the documents necessary and assist you in your role as the fiduciary of the estate. Emotions run high when siblings, cousins, in-laws, and other potential beneficiaries are involved in the administration of a loved one's estate. Disputes arise between beneficiaries and personal representatives (PR) or trustees for a variety of reason. If a PR or trustee (fiduciary) fails to fulfil his or her duties as the fiduciary of the estate, the beneficiaries have standing to challenge the actions and the appointment of the fiduciary. If the court finds that the personal representative or trustee has wasted or maladministered the assets, is not physically or mentally capable of acting as the fiduciary, engaged in self-dealing, or for some other valid reason the court may remove the fiduciary or take whatever action is necessary to ensure that the estate assets are protected, and the estate is properly administered. We also focus on representing women in legal matters and educating women on their legal rights. Women may not enforce their legal rights for a variety of reasons.
