Filing a homestead declaration provides significant protection for your home from numerous creditors and offers some protection during your lifetime and that of your spouse.
However, having a homestead declaration does not guarantee complete protection from MassHealth's estate recovery after the passing of loved ones. If you or your spouse receives long-term care under MassHealth, your home may be subject to recovery if adequate protections are not in place.
