With the arrival of summer, young people across the country are about to reach a key milestone: high school graduation. If you have a child claiming their diploma, now is the time to prepare them for life after leaving the nest.

While your child will now be a legal adult, you still have essential parental duties. You can support your child stepping into adulthood by setting them up with legal documents. Without these, it can be challenging and costly for you to help them in the event of an emergency.

Signed into law on March 11th, President Biden’s $1.9 trillion American Rescue Plan Act of 2021 (ARP) is the largest direct-to-taxpayer stimulus legislation ever passed, and it came just in time to save millions of Americans whose unemployment benefits were about to expire. On October 15th, nearly two months after the death of Black Panther star Chadwick Boseman, his wife, Taylor Simone Ledward, filed documents with the Los Angeles probate court seeking to be named administrator of his estate. Earlier this year, Boseman and Ledward were married, and the marriage gives Ledward the right to any assets held in Boseman’s name at his death.

Boseman died at age 43 on August 28th following a four-year battle with colon cancer, and based on the court documents, it seems the young actor died without a will. While Boseman’s failure to create a will is surprising, he’s far from the first celebrity to do so. In fact, numerous big-name stars—Aretha Franklin, Prince, and Jimi Hendrix—all made the same mistake.

Happy Friday! In connection with Estate Planning Awareness Week, we are posting misconceptions about Estate Planning. Here’s Myth #4.

The reality is that a power of attorney is only good while someone is alive, usually effective upon their incapacity. To handle a decedent’s affairs at their death, you must be appointed as an executor - or better yet - in the case of a Trust, as the Successor Trustee. Remember that the way to avoid probate is through a fully funded, properly drafted, living trust with disability provisions.
