When an unmarried couple has a child together, establishing paternity is necessary for ensuring a judge does not deny the father custody, visitation, child support, or other legal parental rights. Naming the father on the birth certificate is the easiest method for establishing paternity, but California law requires that the father sign a voluntary declaration of paternity before their name may be added to the birth certificate. If the father does not sign this document and the couple splits up, the mother will be required to prove paternity before requesting child support.
