Spending $$$$ on Branding before hiring an Experienced Trademark Attorney to run a Comprehensive Search on the name and/or logo you intend to use!

Don’t risk it all! Rebranding is Expensive and avoidable by simply doing things the right way.

Before you launch (or as soon as possible if you’re already in business):

Make sure your name is AVAILABLE!

- Contact an experienced Trademark Attorney
- Make sure there is a Comprehensive Search done to identify any and all Similar and Confusingly Similar marks (both Pending and Existing) which the USPTO could use as a basis to refuse your application.
- The Search should include all common law trademarks, state trademarks, social media accounts, and business records (at least) to identify any potential Notice of Oppositions during the Publication phase of the application process.
- Make sure special attention is placed on marks which offer the same or similar goods and/or services.
- Strategize with your Attorney depending on your research results.

File the Correct Application!

- If you have not yet launched, you will be filing a 1(b) Intent to Use application.
- If you are already in business, you will be filing a 1(a) Already in Use application.
- Understand that both applications have different outcomes and requirements.
- Both applications will require you to pay a filing fee, starting at $250, per class.

The cost of doing things the right way for your business is minimal compared to the cost of rebranding and facing a potential lawsuit from the business who owns the Trademark rights you’re using.
