Nebraska no longer requires one party to prove fault to dissolve a marriage. Infidelity, abandonment, and abuse, things that used to carry significant weight in court, may not be relevant at all to your case today.

If one party wants out of the marriage, the marriage will be dissolved. It does not require consent from the other party, and it does not require proving fault.

At Husker Law, the goal is always for the client to be happy, but part of being a good attorney is telling clients what is actually going to happen, not just what they want to happen. That can be a hard reality.

If you want your divorce done in a reasonable amount of time, there will need to be negotiation and movement from both sides. Going in with an open mind and focused on what truly matters, not the non-essential items, is what gets you to the other side as quickly as possible.

When parties simply realize the marriage is not working and want to move on without fighting, the case can be over in a couple of months and is relatively inexpensive.

When the separation is abrupt or emotions are still running high from the triggering event, those cases can take upwards of a year. The level of tension between the parties is what drives the timeline more than anything else.

Your first hearing is just the beginning. In all misdemeanor cases, the prosecution is required to share discovery with your attorney, police reports, any video, audio recordings, and data collected by police such as breathalyzer information.

All of that is provided to your attorney after that first court hearing, and that is when the real work of building your defense begins.

When you are falsely accused, the worst thing you can do is go talk to your friends and family about what happened. None of them are protected by law from having to divulge what you tell them.

Even if you are telling them you did not do what you were accused of, you are giving them a set of facts you will be stuck with, regardless of what any video, DNA, or fingerprint evidence might show. Talk only to your attorney or therapist, both of whom have privilege.

When parties are unwilling to settle and require full litigation, Nebraska divorces can take upwards of 18 months, partly due to court docket availability and fitting the case into the attorney's schedule.

While that timeline may move quickly for the attorney, it is a day-by-day reality for the clients living through it. Staying open to settlement from the start can save significant time, money, and stress.

At the first hearing, it is always important to enter a not guilty plea. You should never enter a guilty plea at the first hearing, no exceptions.

Your first court appearance is not the place to resolve the case. It is the place to protect your position and make sure every option stays open going forward.

You do not have to prove your spouse did anything wrong to file for divorce in Nebraska. If one party wants out of the marriage, the dissolution will happen, no consent or proof of fault required.

Understanding how no-fault laws affect your specific situation is the first step to navigating your case wisely.

When you are charged with domestic violence and going through a divorce or custody action at the same time, you are a parent first, your kids come first.

But this is exactly why you need an attorney who can handle the domestic violence case and the custody case simultaneously, so you never have to make that impossible choice between defending yourself and protecting your children.

The fastest it can happen is approximately 61 days, that is somewhat rare. Even when parties are in complete agreement, the process often runs closer to six months.

In cases with significant assets, debt, or high conflict, the timeline moves out closer to a year or longer. The process takes as long as it needs to, and that length is largely determined by the parties.
