After a car accident, many people focus on the damage to their vehicle — but the medical records created after the crash are often what truly determine the strength and value of a personal injury claim.

Emergency room records, MRI findings, surgical reports, physical therapy notes, and specialist evaluations can all become critical evidence in a Nebraska injury case. Insurance companies carefully review these records when deciding whether to accept, deny, or challenge a claim.

Even treatment gaps that happen for completely understandable reasons — like work obligations, insurance delays, or trying to “tough it out” — are often used against injured people.

Our latest blog explains:
✔ What medical records matter most after an accident
✔ Why early treatment documentation is important
✔ How imaging studies and surgery records affect claims
✔ Why consistency in treatment matters
✔ How injury lawyers use medical evidence to build strong cases

After a car accident, the insurance company may contact you very quickly — sometimes within days — offering a settlement check before you even know how serious your injuries really are.

That quick money can be tempting when:

Medical bills are piling up;
You are missing work; and
You just want the stress to be over.

But accepting an early settlement and signing a release can permanently prevent you from recovering additional compensation later — even if your injuries turn out to be much more serious than you first thought.

We often see situations where:
• Neck or back pain later becomes a herniated disc injury;
• Concussion symptoms worsen over time;
• Physical therapy turns into surgery; or
• Future treatment becomes necessary months after the crash.

Many people also do not realize that a Nebraska injury claim may involve much more than just current medical bills, including:
✔ Future medical care
✔ Lost wages
✔ Pain and suffering
✔ Permanent injuries
✔ Underinsured motorist (UIM) coverage issues

Insurance companies are not necessarily trying to help you “move on” — they are often trying to close the claim before the full value of the case is known.

Before signing anything after a Nebraska car accident, make sure you fully understand your injuries, your rights, and the potential long-term impact of the crash.

What Happens If the Other Driver Doesn’t Have Insurance?

Car accidents are stressful enough—but finding out the at-fault driver has little or no insurance can make things even more confusing.

The good news: you may still have options.

In Nebraska, every auto policy includes uninsured/underinsured motorist (UM/UIM) coverage. That means your own insurance can step in when the other driver can’t fully cover your injuries.

But these cases aren’t always simple. Here are a few things to keep in mind:

👉 Uninsured vs. underinsured matters
There’s a big difference between no coverage and not enough coverage—and it affects how your claim is handled.

👉 Your claim may be against your own insurance
UM/UIM claims are made through your policy, which can sometimes lead to disputes over value.

👉 Medical bills don’t wait
Treatment often starts before fault or coverage is sorted out, so understanding how bills get paid is important.

👉 Fault can still impact your recovery
Nebraska law still allows compensation to be reduced if you’re partially at fault in UM and UIM claims.

👉 Hit-and-run accidents fall into this category too
But they require quick reporting and strong documentation.

Bottom line:
Just because the other driver doesn’t have enough insurance doesn’t mean you’re out of options. But how you handle things early on can make a big difference.

Did you know?

People injured as passengers in a car accident often have some of the strongest legal claims under Nebraska law.

Because passengers typically did not cause the crash, they may be able to pursue compensation for:

• medical expenses
• lost wages
• pain and suffering
• long-term injury impacts

Passenger claims can sometimes involve multiple drivers and insurance policies, which is why understanding your rights early is important.

Is the insurance company spying on me?

After a car accident, many people are surprised to learn how aggressively insurance companies investigate claims.

Yes - they often:
-Monitor public social media
-Hire private investigators
-Request years of prior medical records
-Compare therapy notes line by line

What they can't do is invade your home, hack accounts, or access private records without authorization.
