Drunk driving cases get resolved through plea based convictions in courtrooms throughout the State of Michigan every day. For many people, such a conviction is their first and only offense. The person convicted learns their lesson and adjusts their behavior and takes advantage of the rehabilitative programs that are part of the process.

For those individuals that have a first time operating while intoxicated offense conviction and meet other qualifications, Michigan allows for an expungement of the criminal conviction. The court must be convinced that the person has benefited from the rehabilitative programs and that the person is otherwise worthy of an expungement.

Recently, I was successful in expunging a first time operating while intoxicated conviction for a very deserving client. I prepared and produced the proper proofs for the Court, and my application to set aside the conviction was granted.

An interesting part of driver's license restoration cases is that the cases take time - often several years - to complete.

In most cases, when I obtain a driver's license for a client that had his or her license revoked, the client must drive with an ignition interlock device on the client's vehicle for a minimum of 12 months. That means that I have to prepare a client for the original hearing, obtain the restricted license for the client, wait a minimum of 12 months, and then prepare the client for a second hearing - and ultimately obtain a full and unrestricted license for the client.

I get to know my clients. I get to like my clients. I spend a lot of time with my clients. We collectively go through the energy and effort and time expenditure to get things done.

So when I obtain the full and unrestricted license for the client, it is a proud moment in time.

Recently, I was able to complete this journey with a very well deserving client. I diligently prepared the case and all proofs. I guided my client. And I was able to obtain a full and unrestricted license for this client.

When I represent a personal protection order case, I have to understand the dynamics that are occurring between the two sides. I have to know the story that needs to be told. I have to investigate both sides and find the proper pathway to success, applying the facts to the law.

If your vehicle has an ignition interlock device, then you may face an ignition interlock violation allegation. This will re-revoke your drivers license and cause substantial disruption in your life.

Many ignition interlock violations are pure mechanical failure. And sometimes, the person accused of the ignition interlock violation did not have possession of the vehicle at the time of the ignition interlock violation - as a mechanic or other service provider had possession of the vehicle.

I have nearly 18 years of experience with ignition interlock violations. I also have extensive experience with Circuit Court petitions regarding drivers license cases.

Recently, I drafted and filed an ex parte Circuit Court petition and was successful in obtaining an ex parte order to stay a re-revocation for my client. I was able to demonstrate that my client did not violate the administrative rules and was not even in possession of the vehicle at the time of the alleged violation. The Circuit Court agreed and permitted my client to continue to drive with the ignition interlock device in the client's vehicle pending an administrative hearing. I was then successful in the administrative hearing and my client was returned to the restricted license from the Department of State.

I knew the facts. I knew the law. I knew the administrative rules.
